Family cohesion is the legal institution that allows the issuance of a residence permit for family reasons to foreign citizens already legally residing in the national territory.

Who is Family Cohesion for?

✓ adult spouse who is not legally separated; A spouse is treated in the same way as a same-sex partner in a civil partnership as provided for by the regulations on civil unions.

✓ minor children, including those of the spouse, or born out of wedlock, unmarried provided that the other parent, if any, has given consent. Children who are adopted, fostered, or placed under guardianship are treated in the same way as children.

✓ dependent adult children, who are unable to provide for their own living needs due to a state of health that entails total disability

✓ dependent parents, if they have no other children in the country of origin, or parents over the age of sixty-five, if the other children cannot provide for their maintenance for serious documented health reasons.

Family reunification: how is it achieved?

Family reunification is a practice regulated by Article 28 et seq. of the Consolidated Law on Immigration , which allows non-European citizens with legal residence in Italy to obtain authorization for entry and residence in Italy for some of their family members.

The foreign citizen who applies for family reunification must be the holder of a residence permit for at least one year obtained for subordinate or self-employed work reasons, but also for religious study or family reasons.

Family reunification is permitted for married and adult spouses (provision also extended to civil unions between persons of the same sex) of minor children, even those born out of wedlock if the working citizen making the application has expressed his or her consent. Family reunification is also allowed to adults with disabilities and parents over 65 years of age who for health reasons need to be reunited with the foreign citizen who has been transferred.
