Conversion of a community driving licence

The procedure is intended for drivers in possession of a license issued by a state of the European Union or the European Economic Area who obtain a registered residence or a normal residence in Italy.

Driving licences issued by countries belonging to the European Union or the European Economic Area are equivalent to Italian licences.

Conversion of a non-EU driving licence

For holders of a non-EU driving licence, it is possible to drive vehicles to which the licence entitles up to one year from the acquisition of residence. After one year, it is necessary to convert the driving licence in order to drive vehicles on Italian territory. This is possible if the State that issued the driving licence has signed reciprocal agreements with Italy.

Intra-company secondment: what does it mean?

Let’s shed some light on the meaning of intra-company secondment.

Intra-company posting is defined as “temporary posting of a foreign worker by a company established in a third country to the host entity”.

The employment relationship between the worker to be transferred and the posting company located outside the European Union must be governed by the employment contract that has been active for at least three months without interruption immediately before the date of transfer.

InfoVisti will deal with the implementation for the entry and residence of third-country nationals who move for subordinate work, as skilled workers or in training, or managers in the context of intra-corporate transfers both outside the EU and from another Member State.

The posted worker must be hosted either by a host entity established in Italy belonging to the company or to the same group of companies.

Intra-company secondment: what are the obligations of the posting company?

The foreign company that requests the posting of its employees or self-employed personnel is obliged to give prior notice of the posting to the Ministry of Labour and Social Policies within one day before the transfer, delivering the following information:

– Data of the foreign company requesting the posting

– Number of self-employed or paid persons who need to be posted

– Total time frame of the posting, start and end date.

– Address of the place where self-employed or employed persons will work.

– Data of the subjects to be seconded.

– Type of services provided by workers.

– Data of the contact person designated by the foreign company domiciled in Italy and in charge of sending and receiving the deeds and documents.

– Data of the contact person appointed by the foreign company, who as a representative maintains relations with the social partners concerned.

– Number of the authorization to carry out the activity.

Blue Card: What is it?

The EU Blue Card is a specific type of residence permit that was introduced by
Legislative Decree No. 100 of 28 June 2012
and is issued by the Police Headquarters to highly qualified workers from countries that do not belong to the European Union.

The work of the non-European citizen must be regulated by a work residence contract that must have been communicated to the police station.

The duration of validity of the Blue Card differs depending on the singular employment relationship.

If the employment relationship is for a fixed term, the blue card has a duration of two years, if the employment relationship is for a fixed term, the residence permit has a duration of three months longer than the expiry of the employment relationship.

In order to obtain the Blue Card, the non-European citizen must carry out, as a self-employed person, work for another natural or legal person, otherwise who has an employment relationship as an employee. The application for authorization must be submitted by the employer to the prefecture.

Highly qualified work must be certified by suitable educational qualifications and certificates of professional qualification that have been issued by the non-EU citizen’s country of origin.

The blue card can be issued to: foreigners residing in a non-EU country; working citizens who reside on a regular basis in Italy; citizens legally residing in another EU country; citizens who are in possession of the Blue Card issued by another Member State of the European Union.

Highly Skilled Workers: Who Are They?

Highly qualified managers and subordinate or self-employed workers are workers who have obtained recognition for high professional and sector-specific qualification through the certification of their work, which must be specialized in the sector continuously for at least six months.

Executives or highly qualified personnel of companies that have Italian branches, representative offices of foreign companies.

InfoVisti assists managers or staff of foreign companies with a representative office in Italy in their temporary relocation. The staff may have been hired either on a self-employed or subordinate employment contract.

The temporary posting must not exceed five years. Its duration is defined according to the company’s needs and may be subject to extensions.

According to the Decree of the President of the Republic of 31 August 1999 to the Consolidated Law on Immigration, at the end of the transfer it is possible to hire staff on a fixed-term or permanent basis in Italy.

Entry for the self-employed: what do you need?

In order to obtain a visa and transfer, it is necessary to:

– the employment contract stipulated with the company endorsed by the Territorial Labour Directorate.

– Nulla Osta obtained at the police station attached to the request for transfer.

All documentation that demonstrates professional skills and work in the company sector for at least six months.

Entry for the employee: what do you need?

In order to obtain a visa and transfer, it is necessary to:

Request for Nulla Osta to work that must be sent to the Immigration Desk in the prefecture by the company after filling out a special form.

Residence permit: how do I apply for it?

In order to apply for a residence permit, foreign citizens must apply to the Police Headquarters of the province in which the citizen wishes to stay, according to
Article 5, paragraph 2 of Bill 286/98
and subsequent amendments to
the Consolidated Law on Immigration
.

A residence permit must be applied for within 8 working days of entry, otherwise the request will be refused and the foreign citizen will be expelled, unless the delay is due to him, or force majeure.

The request will be submitted to the Police Headquarters of the province where the citizen wants to stay through the “Sportello Amico” of the authorized Post Offices.

With regard to the Residence Permit required for subordinate work, a completed form must be submitted to the Immigration Desk of the UTG Prefecture. Also in this case, the deadline of 8 days from entry applies.

The residence permit required for self-employment or subordinate work can ONLY be used for the provision of the reported service, a work activity for which the authorization has been granted.

Special cases for job transfer: what are they?

The request for entry for work is regulated individually according to each particular case according to the provisions of art. 27 of the Consolidated Law on Immigration.

Family reunification: how is it achieved?

Family reunification is a practice regulated by Article 28 et seq. of the Consolidated Law on Immigration , which allows non-European citizens with legal residence in Italy to obtain authorization for entry and residence in Italy for some of their family members.

The foreign citizen who applies for family reunification must be the holder of a residence permit for at least one year obtained for subordinate or self-employed work reasons, but also for religious study or family reasons.

Family reunification is permitted for married and adult spouses (provision also extended to civil unions between persons of the same sex) of minor children, even those born out of wedlock if the working citizen making the application has expressed his or her consent. Family reunification is also allowed to adults with disabilities and parents over 65 years of age who for health reasons need to be reunited with the foreign citizen who has been transferred.
